FAQ – Frequently asked questions in trademark law
A trademark protects distinctive features such as names, logos or slogans, while a design protects the external appearance of a product. Both rights serve to protect your corporate identity, but in different ways.
A patent protects a novel technical innovation and undergoes a lengthy examination process for this purpose.
A patent expires automatically after a certain period of time (usually 20 years) and can then be imitated by third parties (public domain).
Trademarks are protection rights that can be renewed indefinitely and protect the marketing and exploitation of these products under the individually chosen names exclusively for the trademark owner.
Trademarks represent considerable value for products and/or services, as they refer to their origin from a specific company and thus have a high recognition value and at the same time represent a mark of quality. This protection allows the trademark owner to claim this powerful market position for themselves and use it profitably with a good strategy.
Patent attorneys often register the associated trademarks in addition to the patents, but are not authorised to defend trademark rights before the ordinary courts (regional court, higher regional court, Federal Court of Justice). This requires fully qualified lawyers (1st and 2nd state examinations) who are admitted to the bar.
Trademark protection is initially valid for 10 years from the date of application. It can be renewed for further periods of 10 years as often as desired, provided that the trademark is in use and the renewal fees are paid.
The costs depend on the scope of protection. A German application to the DPMA starts at around EUR 300. An EU trademark starts at around EUR 850. International trademarks must be calculated depending on the target countries.
Yes, but there is a high risk of errors – for example, in the selection of classes, in the registration of conflicting grounds for refusal (the registration costs are not reimbursed by the offices) or the risk of conflict with older trademark owners. A registration accompanied by a solicitor increases the protective effect and reduces the potential for conflict in the long term.
A trademark infringement occurs when third parties use an identical or similar sign for identical or similar goods/services for which the earlier trademark is protected without permission.
